Long Arm Jurisdiction at the UPC: The Court of Appeal Sets the Limits — Dyson/Dreame, KeeeX/Adobe, and Hamburg's Self-Correction

Episode 45 - Three landmark decisions in one month have redefined the UPC's territorial reach. The Court of Appeal made its first-ever CJEU referral in Dyson v Dreame, asking whether third-state defendants can be joined via EU authorised representatives for non-UPC states. In KeeeX v Adobe, the Court firmly rejected Article 7(2) long arm jurisdiction based on website accessibility. And Hamburg Local Division became the first court to apply this guidance, correcting its own earlier position and distinguishing cases where the anchor defendant has a substantive role from those where the link is purely regulatory. Episode 44 - Are UPC cases gravitating to just a few divisions and what does that say about power, politics, and access to justice? 

In this episode, moderator George Walden talks with Dr. Eugen Popp: The starting point for the following discussion of today’s topic is Article 33 of the Agreement on a Unified Patent Court (UPCA), which sets out the competence of the divisions of the Court of First Instance. Within certain limits, this article permits a so-called ‘forum shopping’, i.e. it allows a potential claimant to choose the court of first instance that appears most suitable to him/her. ‘Most suitable’ is at the heart of ‘unequal distribution’.
